PHOTOGRAPHIC BOOKINGS TERMS & CONDITIONS

Clarification of terms

The 'client' means the person, company or organisation hiring the studio and includes all personnel working for or connected with the client on whatever basis.The 'hire period' includes all the time when the client is in occupation including times when client's equipment or other belongings are in the building even though the building is locked and no-one is present. The 'studio' means all or any part of the building including the grounds and surroundings, even those not specifically hired to the client. ‘Motel Studios’ is a trading name of MOTEL Ltd.

The Agreement

Motel Studios can make no promises as to availability of the studio unless confirmed in writing. The period of hire cannot be extended except by prior agreement. Motel Studios provide only public liability insurance cover for clients hiring the studio. Loss or damage to the client’s possessions or equipment, damage caused by the client and/or accidents caused by the client are in no way the responsibility of Motel Studios. To the satisfaction of Motel Studios, clients will repair damage and make good losses they cause during the hire period. The client agrees to protect the studio against theft and damage. The client accepts responsibility for ensuring security throughout the hire period. The client takes responsibility for following all health and safety guidelines (including Covid-19 regulations) during the hire period. A representative of Motel studios will be available to provide training upon request at a mutually convenient time before the hire commences. Motel Studios shall have no liability to the client for consequential losses which result from power cuts, external noise or other events or breakdowns which delay or prevent use of the studio. Liability shall be limited to an additional hire period at the discretion of Motel Studios. During the hire period the client shall not cause noise or other disturbance in the neighbourhood which could lead to action by individuals or organisations against the studio. Where Motel Studios provide additional services, any persons performing these services are servants of the client and are under the sole control and direction of the client. When entering any other area of the building without being accompanied by an agent of Motel Studios, a client accepts responsibility for ensuring the safety and security of that area even though that area has not been hired to the client. Any defects found in the studio infrastructure should be brought to the attention of a representative of Motel Studios. A client who identifies an unacceptable risk then continues to work is deemed to accept liability for any consequences that follow. Unless agreed in writing the client takes responsibility for all costs incurred by their use of the studio including electricity, telephone bills, equipment hire, taxis, food and the like. At the end of the hire period the client agrees to leave the studio in a condition equal to or better than its condition at the commencement of the hire period. The hire period does not end until the studio is formally handed back to a representative of Motel Studios. You agree not to leave our spaces unoccupied without notifying a member of staff and or ensuring the security of the studio. Motel Studios reserves the right to charge for the storage of items left behind in our premises where it is deemed that those items prevent the use of, or restrict a 3rd party client enjoying the use of the space.

Additional Charges/Credit Card Charges

Clients may be required to, or choose to pay charges in advance of the hire date by Credit Card. Unless otherwise agreed, payment for all outstanding purchases, hire fees, overtime or services commissioned, will be charged to your card on completion of your visit (or cancellation thereof within seven days of your booked dates).

Equipment rental

Insurance excess is £250.00 per claim. Exclusions include damage through negligence and glass breakages. 

Charges payable when cancelling a photographic studio booking within 7 days of the booked date

MOTEL reserves the right to charge for cancellations in keeping with the following schedule:

Cancellation 7 days or more prior to the photographic booking date: No charge

Cancellation 6 days prior to the photographic booking date will result in a charge of 30% of the total cost,

Cancellation 5 days prior to the photographic booking date will result in a charge of 40% of the total cost,

Cancellation 4 days prior to the photographic booking date will result in a charge of 50% of the total cost,

Cancellation 3 days prior to the photographic booking date will result in a charge of 60% of the total cost,

Cancellation 2 days prior to the photographic booking date will result in a charge of 75% of the total cost,

Cancellation 1 day prior to the photographic booking date will result in a charge of 100% of the total cost,

Payment Terms 

Any charges invoiced post hire must be paid within 30 days. Should any dispute arise which is not covered by this document the client agrees to be bound by the generally accepted terms and conditions being applied by other companies who hire out studio and/or location facilities to the media industry. Clients who do not understand any of these terms and conditions should seek clarification from a representative of Motel Studios.

Insurance

Each hirer undertakes and confirms that for the duration of the hire;

a) they have in force Public and Products Liability and Production  insurance and that such insurance

i) shall indemnify the Insured in respect of liability arising from the work carried out at MOTEL

by the hirer

ii) has a Limit of Indemnity not less than GBP 5,000,000 or currency equivalent

iii) where a limit of GBP 10,000,000 is in force for the insured a limit of indemnity as above will be sufficient except for hirers or their Bona Fides Sub Contractors supplying Heat Work services where their limit of indemnity should also be GBP10,000,000

b) they have in force Employers' Liability insurance or Workers' compensation insurance where employees

are contracted to carry out the work.

The following activities carried out or arranged on behalf of the hirer shall be contracted out

by bona fide sub-contractors holding their own Public Liability cover of no less than £5,000,000

a) Security or crowd control

b) height work above 10 metres from the ground or stage or floor level

c) fireworks or pyrotechnics

Overtime

Please note that we grant 30 minutes grace period before and after your shoot to allow you to arrive and depart comfortably. If your crew leaves more than 30 minutes after your booking time we charge overtime as 1 full hour and 1 hour is charged for any part of an hour thereafter. Overtime includes our staff remaining behind to facilitate collections.
Power Levy

Due to the ongoing increases in power costs, we charge a set fee of £80.00 to cover electricity usage for any lighting brought to MOTEL from a 3rd Party Lighting company, a photographer or your own production crew. ie any lighting which is not hired through MOTEL or as part of our partner arrangements. We also reserve the right to charge the same power levy where clients use constant lighting over 5 KW (Total Kilowattage) irrespective of whether the equipment is hired via MOTEL, owned by you or your photographer or hired from a 3rd party source.
